Blue Waves Surf House Terms and Conditions

1. Contract Information

This agreement is made between BLUE WAVES TRIBE SL (hereinafter referred to as "Blue Waves"), a booking company that facilitates reservations for surf and yoga travels around the world, and the individual or entity making the booking (hereinafter referred to as the "Client"). Blue Waves is a legally registered company with its registered office located at Paseo Alcade Sanchez Prados 6, 6º A, 51001 Ceuta (Ceuta), España, and operates under the NIF number B13856612. By making a booking with Blue Waves, the Client agrees to adhere to these terms and conditions. In the case of group bookings, the individual who makes the booking (the "Lead Name") must have the authority to agree to these terms on behalf of all participants in the group. The Lead Name will be responsible for all communication, payments, and any changes or cancellations regarding the booking.

2. Booking and Payment Conditions


2.1 Booking Confirmation

2.1.1 Binding Agreement: Your booking is considered binding only when Blue Waves sends you a written confirmation. We reserve the right to refuse any booking at our discretion without providing a reason.

2.1.2 Deposit for Standard Bookings: For individual or standard bookings (not large group bookings), a deposit of 75% of the total booking amount is required to secure the reservation, with the remaining balance due upon arrival or as specified in the booking confirmation.

2.1.3 Companies and Large Group Bookings: Companies, retreats, and large group bookings have the option to pay against invoice. A deposit of 50% of the total price is required immediately to reserve the booking, with the remaining 50% to be paid 30 days prior to the arrival date. For invoice payments, clients will receive a single invoice with two distinct payment dates: one for the deposit and the other for the remaining balance.

2.1.4 Group Bookings: If you make a booking on behalf of other participants, you guarantee that you have the authority to accept these terms on behalf of all participants in your group. The Lead Name is responsible for all payments, changes, and communications related to the booking.

2.1.5 Third-Party Bookings: Travelers booking through a third party, such as a university, school, or company, may be subject to additional terms and conditions specified separately by the organizer.

2.1.6 Acceptance of Terms: By confirming a booking, all participants accept our terms and conditions, data protection policy, and the package travel agreement.

2.2 Payment Methods

2.2.1 Available Payment Options: Payments can be made by bank transfer, debit card, or credit card. Any bank or currency exchange fees are the client's responsibility.

2.2.2 Currency Exchange: Significant fluctuations in exchange rates between the booking date and the payment date may result in price adjustments, which will be communicated to the client in advance.

2.2.3 Failure to Pay: If full payment is not made before the due date, Blue Waves reserves the right to cancel the booking.

3. Definitions

"Booking Confirmation" refers to the confirmation of your booking sent to you by Blue Waves.
"Lead Name" is the person responsible for the booking and communication on behalf of the group.
"Force Majeure" refers to unforeseeable circumstances beyond the control of Blue Waves that prevent the fulfillment of contractual obligations.

4. Cancellations and Refunds

If you are obliged to cancel your booking, you should write to Blue Waves immediately. The cancellation date will be deemed as the day that we have received in writing your cancellation request. The following sliding scale determines if your holiday is refundable:

Cancellation over 60 days before arrival – we will refund 90% of the total paid amount.
Cancellation between 59 and 30 days before arrival – we will refund 75% of the total paid amount.
Cancellation between 29 and 14 days before arrival – we will refund 50% of the total paid amount.
Cancellation less than 14 days before arrival – we do not refund. We recommend you to contract travel insurance.
No show (not present on the day of arrival) – we do not refund. We recommend you to contract travel insurance.

5. Insurance

5.1 Mandatory Travel Insurance: All guests must have full travel insurance covering medical expenses, trip cancellations, and loss of personal property. Blue Waves accepts no responsibility for loss, theft, or damage during the stay.

5.2 Blue Waves Cancellation Insurance: Optional cancellation insurance can be purchased at the time of booking, covering specific reasons like illness or injury.

6. Liability and Responsibility

6.1 Limited Liability: Blue Waves is not responsible for any injury, loss, damage, accident, delay, or costs incurred during your stay or participation in activities. This includes events caused by third-party service providers.

6.2 Third-Party Services: We act as an agent for certain services (e.g., tours, transport) and accept no liability for issues arising from these providers.

7. Health and Fitness

7.1 Fitness Requirements: It is your responsibility to ensure that you have the appropriate level of fitness for the activities booked. Please consult your doctor if you have any medical conditions that might affect your ability to participate.

7.2 Medical Declaration: You may be required to submit a medical certificate declaring your fitness to participate in activities.

8. Surf and Weather Conditions

8.1 No Guarantees: Blue Waves cannot guarantee specific weather or surf conditions and is not liable for the impact of poor conditions on your activities.

8.2 Activity Adjustments: In the event of unfavorable weather or surf, we will attempt to offer alternative activities; however, no refunds will be provided if guests choose not to participate.

9. Passports and Visas

9.1 Travel Documentation: It is the responsibility of each guest to ensure that they have a valid passport and appropriate visas for travel. Blue Waves is not liable for any issues arising from incorrect or missing travel documents.

10. Force Majeure

10.1 Circumstances Beyond Control: Blue Waves is not liable for any failure to perform due to circumstances beyond our control, such as natural disasters, pandemics, political unrest, or other force majeure events.

11. Code of Conduct

11.1 Expected Behavior: All guests are expected to behave respectfully towards other guests and staff. Blue Waves reserves the right to terminate the stay of anyone whose behavior is deemed inappropriate, without refund.

12. Data Privacy

12.1 Data Use: Your personal information will be used for booking and communication purposes only and will be handled in accordance with data protection laws.

13. Dispute Resolution and Governing Law

13.1 Governing Law: These terms and conditions are governed by the laws of Spain. Any disputes arising under or in connection with these terms will be subject to the exclusive jurisdiction of the courts of Spain.

14. Amendments to Terms and Conditions

14.1 Right to Amend: Blue Waves reserves the right to update or amend these terms and conditions at any time. The latest version will be available on our website.
